What is an implied license?
An implied license is a legal agreement between the owner of the rights to a piece of intellectual property, such as a song or video, and another party who wishes to use those rights. Under an implied license, the party using the rights does not have to enter into a written agreement or sign an official contract to use the intellectual property. Instead, an implied license is understood to exist when the owner of the intellectual property permits or allows the use of their work. In the context of copyright law in Nebraska, an implied license grants a person the right to use someone else’s copyrighted material without having to ask for permission. In other words, the owner of a copyright may have granted a license implicitly by not responding to the user’s request for permission to use the material. However, this license may be limited in scope, meaning the user cannot do anything with the material other than what was implied. It’s important to note that an implied license is not the same as a copyright violation. The only way to determine if an implied license exists is to contact the copyright owner and ask them directly. If they grant permission or do not respond, then an implied license may be in effect. However, if the copyright owner denies permission, then the intended use of the copyrighted material could still constitute a copyright violation.
