What is copyright permission?
Copyright permission, also known as copyright clearance or copyright licensing, is a legal permission granted by the copyright holder of an original work to use the copyrighted material in a specific way. In Delaware, copyright permission is necessary to reproduce, distribute, or publicly perform a copyrighted work, among other uses. In a copyright permission agreement, the copyright holder grants permission to the third party to use the copyrighted work in a specific way, usually for a set fee. The copyright holder typically retains all rights to the copyrighted work. The third party is allowed to use the work in the ways detailed in the permission agreement, but no other uses are generally allowed. It is important to understand the difference between copyright permission and copyright ownership. If a person has copyright permission, they are only allowed to use the work in a specific way. They do not own the work or have the right to use it however they want. On the other hand, if a person owns the copyright to a work, then they have the exclusive right to reproduce, distribute, and publicly perform the work. In Delaware, it is important to understand the laws surrounding copyright permission in order to respect the rights of the copyright holder. Violation of a copyright permission agreement can result in legal action, including fines and other penalties.
