What is the TEACH Act?
The TEACH Act is a law passed by the U.S. Congress that is designed to provide balance between copyright protection and the educational use of digital works. The law, which stands for Technology, Education, and Copyright Harmonization, was introduced in 2002. The TEACH Act applies to digital works, such as videos, audio recordings, images, and other digital media, which can be accessed remotely over the internet by students enrolled at an Oklahoma school. Under the TEACH Act, Oklahoma schools may perform and display certain digital works for educational purposes without obtaining permission from the copyright owner. This includes performance or display in the classroom and other locations at the school, as well as electronically over the Internet. Schools must, however, comply with certain limitations including that the works used must be limited to what is necessary for instructional purposes, must not be used to primarily promote or generate revenue, and must not significantly undermine the potential market for the copyrighted work. The TEACH Act also allows for the limited reproduction and distribution of these works. But, again, this is only allowed when it is necessary for instruction and is not used for financial gain. Further, the works must include a copyright notice and must be lawfully obtained. Overall, the TEACH Act provides Oklahoma schools with a way to use digital works in their classrooms without breaking copyright law. This is especially important as digital technologies become an increasingly important part of teaching and learning.
