What is a copyright notice and when should I use it?

A copyright notice is a statement that indicates that copyright protection is claimed for a particular work. A copyright notice must include three elements: (1) the word “copyright” or the copyright symbol ©; (2) the name of the copyright owner; and (3) the year of first publication of the work. In Florida, it is not required to provide a copyright notice in order to gain protection for a work, however, having a copyright notice can help to deter infringement and strengthen a copyright claim in court. When creating original works, including literary, musical, visual, or digital works, it is recommended that a copyright notice be included. The copyright notice should be placed either directly on the work or on a notice page that precedes or follows the work. Additionally, it is possible to register your work with the United States Copyright Office to provide added protection. It is also recommended that copyrights be renewed and/or transferred when necessary. For example, if the work is created by an individual but is going to be published by a company, then the company should be listed as the copyright owner and the copyright should be transferred from the individual to the company.
