How are evictions handled under commercial real estate law?

Evictions under commercial real estate law in North Dakota are handled in a slightly different manner than residential evictions. Landlords and tenants are both subject to certain laws that govern the eviction process. Before a tenant can be evicted, the landlord must provide the tenant with written notice of the eviction. This notice will specify the reason for the eviction, the amount of time the tenant has to vacate the property, and whether the tenant must appear in court. If the tenant does not vacate the property within the time stated in the notice, the landlord can then file a Complaint for Unlawful Detainer with the court. The court then issues a Summons and Complaint, which is served to the tenant by a law enforcement officer, the landlord, or another person. The tenant has the opportunity to respond to the lawsuit, and a court date will be set for the eviction hearing. At the court hearing, the landlord will present evidence of why an eviction is necessary and the tenant will have the opportunity to present their side of the story. The court then rules in favor of either the landlord or the tenant. If the court rules in favor of the landlord, an order of eviction will be issued and the tenant must vacate the property within the time stated in the order. If the tenant does not vacate the property, the court can impose fines and/or other punishments. The landlord can then take further legal action to recover unpaid rent or damages to the property.
