What is entrapment in criminal defense law?

Entrapment is an important defense in criminal law in California. It occurs when law enforcement authorities induce or otherwise encourage a person to commit a crime they normally would not have committed. Entrapment is a defense provided in California Penal Code Section 653.2 and states that a person is not to be convicted of a crime if it is proven their involvement was the result of entrapment. Entrapment can involve a law enforcement officer posing as an individual committing a crime or enticing someone to break the law. In order to prove entrapment in court, the defendant must present evidence that they would not have committed the crime if they had not been encouraged, tricked, or persuaded by law enforcement. Additionally, the defendant must prove that law enforcement provided them a temptation to commit the crime that would have been hard to resist. Entrapment is a defense used in criminal law in California to prevent the government from overstepping its bounds and wrongfully prosecuting someone for a crime they were enticed to commit by a law enforcement officer. However, defendants cannot use entrapment as a defense if they had already decided to commit the crime before law enforcement enticed them. If a defendant can prove entrapment, then the criminal charge can be dismissed.
