What is a post-petition claim?

A post-petition claim is a type of debt that is established after a debtor has filed for bankruptcy in the state of California. It can take the form of a loan, credit card debt, or other unsecured debt. In other words, a post-petition claim is an additional debt that is incurred after a bankruptcy petition has been filed. In California, post-petition claims must be addressed and paid off in order to receive a discharge from bankruptcy. Depending on the type of bankruptcy filed, a debtor may have to pay all or a portion of the post-petition claim, or the debt may be discharged altogether. For creditors, a post-petition claim can be a tricky situation. If a debtor cannot pay the claim, the creditor cannot pursue the debtor for the debt after a bankruptcy discharge is granted. However, creditors can still pursue collection of post-petition claims if they can prove that the claim was incurred through fraud or misrepresentation. In the end, it is important for both debtors and creditors to understand the laws surrounding post-petition claims. Debtors should be aware that any debt incurred after filing for bankruptcy may need to be addressed, and creditors should understand their rights when it comes to collecting post-petition claims.
