What is a discharge injunction?
A discharge injunction is a legal term used in creditors’ rights law that refers to an order issued by a court that prevents creditors from collecting a debt from the debtor. This type of injunction is commonly issued in the state of Texas to stop creditors from attempting to garnish wages, seize or repossess property, or even collect money due to the debtor from other sources. However, a discharge injunction does not mean that the debt itself has been eliminated. It only prevents creditors from taking action to collect the debt. The injunction will remain in effect until the debtor pays off the debt or proves that they are unable to pay, or until the creditor decides to settle the debt for less than the full amount. In addition to preventing creditors from collecting a debt, discharge injunctions can also provide debtors with additional protection. For example, creditors may be required to provide debtors with advance notification of any collection actions they plan to take against them. They may also be prohibited from harassing or intimidating debtors. Finally, discharge injunctions can provide debtors with an opportunity to negotiate with creditors and arrive at a settlement agreement. This can help debtors who are struggling financially but don’t want to default on their debt.
