What debts cannot be discharged in Chapter 7 Bankruptcy?

In Chapter 7 Bankruptcy, there are some debts that cannot be discharged or forgiven by the court. These debts include certain taxes, court-ordered child support, alimony, student loans, criminal fines and restitution, and other debts related to personal injury or death caused by operating a vehicle while intoxicated. Certain types of taxes, such as income taxes, penalties, and interest, cannot be discharged in Chapter 7 Bankruptcy, regardless of the amount owed or when the taxes were due. If the taxpayer is considered “willfully” delinquent in filing or paying taxes, the tax liability may never be discharged. Child support, alimony, and other payments for the benefit of a dependent cannot be discharged under Chapter 7 Bankruptcy. Additionally, payments related to personal injury or death caused by operating a vehicle while intoxicated cannot be discharged. Student loans are another type of debt that cannot be discharged in Chapter 7 Bankruptcy, unless you can prove that repaying the loan would cause you an "undue hardship." To be successful in a Chapter 7 Bankruptcy discharge of a student loan, you must prove that you are unable to support yourself and your dependents on your current income, that you are unlikely to be able to repay the loan in the future, and that you have made a good faith effort to repay the loan. Finally, criminal fines and restitution imposed by a court as part of a criminal sentence cannot be discharged in Chapter 7 Bankruptcy. The court must have rendered judgment before filing for bankruptcy for these debts to be discharged. In summary, Chapter 7 Bankruptcy may not discharge certain taxes, court-ordered child support, alimony, student loans, criminal fines and restitution, and other debts related to personal injury or death caused by operating a vehicle while intoxicated.
