How long does it take for the bankruptcy filing to be finalized?

The length of time it takes for a bankruptcy filing in Washington to be finalized depends on a few factors. Generally, the process can take anywhere from three to five months from the time of filing to the time the bankruptcy is discharged. Upon filing for bankruptcy, the debtor must attend one meeting with their creditors and the Trustee appointed to the case. This meeting of creditors, also known as the 341 hearing, is usually set to occur within thirty to forty-five days of the initial filing date. During this hearing, the Trustee and creditors may ask the debtor questions about their assets, liabilities, income and expenses. After the 341 hearing is completed, the Trustee will review and analyze the debtor’s financial information. The Trustee may request additional documents or information prior to forwarding their recommendation to the court. If the Trustee finds that all requirements are met and there are no objections, they will make a recommendation to the court and the court will discharge the bankruptcy. This process can take up to four months after the 341 hearing. Once the court discharges the bankruptcy, a “Discharge of Bankruptcy” document is filed, which will finalize the bankruptcy process. After the filing of this document, a debtor can begin rebuilding their credit and financial future.
