What happens to my creditors when filing for Chapter 7 Bankruptcy?
When filing for Chapter 7 Bankruptcy in Washington, your creditors will be affected. Generally, when a person files for Chapter 7 Bankruptcy, the court will issue an automatic stay. This prevents any of your creditors from continuing to attempt to collect a debt from you. They must first receive permission from the court. In addition, a trustee will be appointed to your case. This trustee is responsible for analyzing your assets, assessing the value of those assets, and liquidating them if necessary in order to pay your creditors. They will send out notices to creditors to alert them of the bankruptcy case. Your creditors will then have the opportunity to file a claim with the court in order to get some of the money they are owed. However, some of your creditors may not be able to receive any of the money they are owed because there may not be enough money to cover all the claims. In some cases, the court may ask the creditors to accept an offer to settle the debt for a reduced amount. Once the trustee has finished liquidating the assets, they will distribute the money among the creditors according to the court’s order. Once the process is complete, the lender will no longer be able to collect on the debt. In most cases, the debt will also be discharged, meaning the debtor no longer owes the money.
