How do I know if I will qualify for Chapter 7 Bankruptcy?
To qualify for Chapter 7 bankruptcy in Washington, certain criteria must be met. The first requirement is for the applicant to pass a means test, which compares the applicant’s average gross income for the six months prior to filing with the median income of the state. If the applicant’s average income is below the median, then they will qualify for Chapter 7 bankruptcy. Applicants must also meet certain eligibility requirements, such as having at least one debt that is more than three months overdue and having been a resident of Washington for the past 180 days. Additionally, the applicant must have received credit counseling from an approved agency in the 180 days prior to filing for bankruptcy. Once all of these requirements have been met, a bankruptcy petition must be prepared and filed with the court. Upon review of the petition, the court will determine if the applicant meets the criteria for Chapter 7 bankruptcy.
