How long does a parent have to contest a child support order?

In Virginia, a parent has sixty days from the date the child support order was issued to contest it. The parent must file a notice with the court that issued the order. This notice is called an “Answer” and must include the grounds that the parent believes the order should be changed. The Answer should be delivered to the court and any other part of the child support order. It is important to note that a parent can only contest a child support order if they have a legally valid reason for doing so. Examples of legally valid reasons include a significant change in circumstances, such as a parent becoming disabled, or a change in the child’s financial situation, such as the other parent receiving a raise at work. A parent must act quickly if they want to contest a child support order. The court is not likely to accept the Answer after the sixty-day period has expired. If the court decides to change the order, the new order will be effective immediately following the old one. The old order will be considered null and void.
