How do parents modify a child support agreement?

In California, a child support agreement can be modified if both parents agree to the changes or if there is a “substantial change of circumstances”. A substantial change of circumstances can be anything from a job loss to a change in health insurance coverage. To modify a child support agreement, a parent must file a petition to modify the existing order in the superior court. Along with the petition, they must attach a completed Child Support Application Form and a Status Declaration/Income and Expense Declaration stating the current situation. If the parents agree to the modified agreement, they can write up and sign an agreement and file it with the court. The court will then review the agreement and most likely approve and enter the stipulated agreement into the court order. If the parents do not agree on the modified agreement, or if one parent is not willing to modify the agreement, either parent can ask the court to modify the agreement. This can be done by filing a Request for Order, stating what terms the parent believes should be modified. The court will then review the requests and issue a court order if necessary. In any case, parents must be sure to fill out all of the necessary paperwork correctly and correctly state their current situation. This will help the court accurately review the modification request and make a decision to ensure that the child’s needs are met.
