What is a cost of living adjustment for child support?

A cost of living adjustment (COLA) for child support is a change in the amount of child support ordered by a court to reflect a change in the expenses associated with raising a child. These expenses may rise due to inflation or other economic factors. California’s family code requires that courts consider all changes in the living expenses of the child in determining the proper amount of support. In California, courts are required to review the amount ordered for child support every three years to determine if a cost of living adjustment is necessary. If a change has occurred in the cost of living expenses, then the court has the authority to adjust the amount accordingly. Factors that courts consider include the school tuition of the child, medical expenses, extracurricular activities, and any other changes in the cost of living for the child. When a court adjusts the amount of child support, both parents must be informed of the change and given an opportunity to object. The court will take into consideration any objections. If the court does not take into account an increase in expenses for the child, then the parent may be able to prove that the child support amount does not adequately reflect the cost of living for the child. The parent may also be able to prove that the other parent has the means to pay additional support.
