What are the deadlines for filing documents during Chapter 13 Bankruptcy?
In Virginia, filing documents for Chapter 13 Bankruptcy must be done within certain deadlines. Depending on the type of bankruptcy filed, the deadlines for filing the documents will be different. First, for those filing a voluntary petition, the deadline is the day the petition is filed with the bankruptcy court. This deadline is firm and cannot be extended. Additionally, the debtor must file a proposed repayment plan, along with any other applicable documents, within 15 days after filing the voluntary petition. For those filing an involuntary petition, the deadline is 30 days after the date of the order for relief. As with the voluntary petition, this deadline is firm and cannot be extended. In either case, the debtor must file all additional documents required by the court within 45 days after filing the petition. This includes a statement of financial affairs and any amendments to the proposed repayment plan. Finally, the debtor must complete any remaining documents required by the court and begin making payments on the plan within 45 days after filing the petition. The plan must be completed within 60 days after the date of filing the petition. It is important for debtors to be aware of and meet these deadlines in order to avoid having their cases dismissed. In addition, the court may impose fines or penalties if documents are not filed or payments are not made by the established deadlines.
