What is a contract?
A contract is an agreement between two parties that creates an enforceable legal obligation. In Washington State, contracts are typically used to create a legal relationship between two people, typically involving an exchange of goods, services, or money. Under Washington contract law, to be legally binding and enforceable, the contract must contain certain elements. First, both parties must have the legal capacity to enter into the agreement, meaning they must be of legal age (18). Third, the contract must have consideration, meaning that each party must give something of value to the other in exchange for the terms agreed upon. Fourth, the parties must have an intent to be legally bound; each must intend to enter into a legally enforceable agreement. Finally, the contract should be in writing and signed by both parties. In Washington, contracts are generally viewed as binding agreements and the courts will enforce them. It is important to understand the legal requirements of a contract, as well as all terms of the agreement, before entering into one. If one party breaches a contract, the other party may be able to take legal action to recover any damages caused.
