What is a contract of employment?

A contract of employment is an agreement between an employer and an employee. It outlines the terms and conditions of their relationship, such as job duties, pay, benefits, and other aspects of the job. In Virginia, a contract of employment is generally either an express or implied agreement. An express contract is one where the terms and conditions are specifically stated in writing and, once agreed upon, are legally enforceable. On the other hand, an implied contract is one where the terms and conditions of the agreement are inferred from the actions of the parties. In either case, the parties must both be on the same page when it comes to the terms and conditions of their relationship. In Virginia, there are certain minimum requirements that must be included in a contract of employment, such as the duration of the employment and the parties’ rights and responsibilities. Additionally, additional conditions can be added in writing, such as payment, holidays, sick leave and other benefits. A contract of employment may also be used to define the work relationship between an employee and an independent contractor, which is a separate agreement from an employment contract. In Virginia, as in many states, employers are required to provide employees with a fair and just working environment. This means that the employment contract must protect the employee’s rights, such as the right to reasonable wages and the right to reasonable working conditions. Additionally, an employee is entitled to reasonable notice if the employment relationship is terminated. This can include an advance written notice and termination pay.
