Does a civil union provide any spousal support?

In Alaska, a civil union does not provide spousal support for either partner. In order to legally enforce any spousal support, both parties must obtain a court order known as a “spousal maintenance” order. This order is based on the parties’ individual financial needs and contributions to the union. Prior to entering a civil union, it is important for both parties to understand that a court order is necessary if either partner wishes to have spousal support as part of the agreement. Without a court order, the financial obligations of the relationship are not legally binding. In addition, it is important to keep in mind that even if both parties agree to provide spousal support, the legal enforceability of that agreement is subject to the laws of the state in which the union was formed. In Alaska, a civil union is not considered a “marriage” or “domestic partnership” for the purposes of spousal support, so any agreement made between the parties would not be legally binding. Therefore, if either partner to the civil union wishes to enforce spousal support, they must obtain a court order. This order is necessary to make the spousal support enforceable and provide financial security to the supporting partner.
