Is a civil union a legal contract?

In Alaska, a civil union is a legal contract that is similar to marriage. It is a formal agreement recognized by the state, granting rights and responsibilities to both partners in the union. These rights and responsibilities, however, are not as extensive as those associated with marriage. The purpose of the contract is to allow individuals in same-sex relationships to benefit from many of the same legal rights afforded to couples that are married. These rights may include shared financial responsibility, rights to inherit assets from a partner, and shared benefits from Social Security or employer-sponsored health plans. Civil union contracts must be drafted according to laws set forth by Alaska. Specific requirements, such as the exchange of property, must be included in the contract. Additionally, both people must agree to the terms of the agreement in order for the contract to be legally binding. In order for a civil union to be recognized in Alaska, it must be registered with the state. This is done by filing an Affidavit of Domestic Union. Once filed, the state will recognize the union and both persons in the relationship will receive the associated rights and responsibilities. By law, the rights granted to couples in a civil union are equal to those granted in a traditional marriage. However, those rights do not extend to federal benefits like tax filing status or immigration status. In addition, civil unions are not recognized by all states, so couples may not have the same rights when traveling to those states.
