Can a civil union be revoked?

Yes, a civil union in Virginia can be revoked. In order to do so, a couple must submit a written request to the Circuit Court that issued their civil union certificate. The request must also be signed by both parties involved in the civil union. If the couple is unable to agree on a joint request, either party may make an individual request to the court. In Virginia, dissolution of a civil union is similar to the process of legal separation. There are two methods to dissolve a civil union: voluntary dissolution and involuntary dissolution. Voluntary dissolution is done by agreement between the parties, and involuntary dissolution is done by court order. In either case, one or both parties may bring a petition to the court that issued the civil union certificate. In some cases, a court order may also be needed to revoke a civil union. If the court finds that the civil union was entered into by fraud, coercion, or under duress, it can be revoked. In other cases, if the court finds one or both parties have been living apart for a certain period of time, it may also revoke the civil union. Once a court revokes a civil union, the partners are again considered individuals, and any rights or privileges they had while in a civil union cease to exist. Neither party is entitled to any form of support or alimony from the other party, and no portion of property acquired during the civil union will be divided.
