What are the elements of a civil fraud claim?

A civil fraud claim, under Washington state law, is a claim brought by a person or company alleging that another individual or company has acted in a way that was fraudulent, deceptive, or dishonest and caused them a financial or other type of loss. For a civil fraud claim to be successful, the claimant must be able to prove four elements: 1. The defendant made a false representation of material fact. This means that the defendant must have made a statement or committed an act that was not true or factual. 2. The defendant must have been aware that the representation was false, or should have been aware that the representation was false. 3. The defendant must have intended that the claimant rely on the false representation. 4. The claimant must have suffered a financial or other type of loss as a result of the false representation. In Washington, there are additional requirements for a successful civil fraud claim. The claimant must have relied on the false representation, meaning that the false representation must have been the basis for the claimant’s decision-making. Additionally, the claimant must have suffered some kind of direct injury, such as a financial loss, from the false representation. If all of the above elements can be proven, then a court will consider the case and determine if the claimant is entitled to damages. Damages will depend upon the specific facts of the case but can include compensatory damages, punitive damages, and attorney’s fees.
