What is the difference between civil fraud and fraud in the inducement?
The difference between civil fraud and fraud in the inducement is the intent behind the fraudulent act. Civil fraud occurs when a person deliberately attempts to deceive another for material gain or to damage someone else’s property or rights. Fraud in the inducement, on the other hand, occurs when a person knowingly misrepresents the truth for the purpose of getting another person to enter into a contract. In the state of Virginia, civil fraud is considered a tort and is treated as a common law crime. In a civil fraud lawsuit, a plaintiff must prove four elements: (1) a false statement of fact; (2) knowledge of the falsity of the statement; (3) an intent to deceive; and (4) resulting damages.
