What are the rules and procedures for jury selection?
In Idaho, jury selection for a trial follows the same general process as jury selection in most other states. To start, a list of prospective jurors is created from the local population. Potential jurors are chosen from this list by a process called “voir dire”. Voir dire is a process where the judge and attorneys ask questions of prospective jurors to determine if they are capable of serving on the jury for the case. For example, the judge or attorneys may ask questions to see if the prospective juror has any prior knowledge of the case, or if they would be unable to keep an open mind on the subject. Once the attorneys and judge have examined each of the prospective jurors, they can reject certain jurors for “cause.” This means that the juror cannot serve on the jury due to some factor such as bias, or prior knowledge. The attorneys for each side of the case can also reject a certain number of jurors without giving a reason, a process known as “peremptory challenges.” Peremptory challenges are used to help ensure that the jury is impartial. After the prospective jurors have been questioned, the challenge process is complete, and the court will swear in the remaining jurors to serve on the trial. These jurors will hear the evidence presented in the trial and determine the outcome of the case.
