How long do parties have to respond to pleadings?

In Idaho, both parties to a civil action have 20 days to respond to a pleading. After one side files a pleading, they must serve a copy on the other side. For example, if a Plaintiff files a Complaint against a Defendant, the Plaintiff must serve a copy on the Defendant. The Defendant then has 20 days to file a response, either an Answer or a Motion to Dismiss. If the Defendant files an Answer, the Plaintiff has 20 days to file a Reply. Once a pleading is filed, the court will often set a hearing or trial date. Prior to the date, the court may also require the parties to file certain documents or participate in certain pre-trial conferences. Depending on the court and the situation, parties may need to object to evidence and make other motions during this pre-trial period. Regardless of the situation, the parties have 20 days to respond to a pleading and must serve a copy on the other side. If the other side does not respond within the 20-day period, they may face consequences. The court may deem the facts in the pleading to be true or they may impose fines or other sanctions. To avoid these consequences, parties should be mindful of the timeline and make every effort to respond to pleadings in a timely fashion.
