What is a motion for reconsideration?
A motion for reconsideration is a legal document that a litigant can file in civil procedure in the state of Hawaii. It gives them the chance to ask a judge to reconsider a prior ruling in the same case. The motion must show the judge that the earlier decision was based on a mistake of law, fact, or procedure. The motion must be filed within ten days of the original ruling in Hawaii. In order to file a motion for reconsideration, the litigant must specify what parts of the ruling they are challenging and why. Once the motion is filed, the other party in the case must respond within ten days. The original ruling can be modified or even reversed depending on the arguments presented by each party. If a judgment has not yet been entered, the judge can also take the motion into consideration and change the ruling. Motions for reconsideration are very important in civil procedure in Hawaii. They provide an opportunity for parties to bring to the attention of the court any errors the judge may have made in the original ruling. As long as the motion is filed within the required time frame and includes a specific argument about the original decision, there is a chance that the ruling can be changed.
