What are the applicable statutes of limitations?

In Michigan, the applicable statutes of limitations (also known as deadline) for civil procedure vary depending on the type of claim or lawsuit. Generally, a personal injury claim must be filed within three years of the date of injury. Claims for breach of contract must be filed within six years of the contract being breached. Libel and slander claims and claims for medical or legal malpractice are required to be filed within two years of the alleged wrongdoings occurring. However, the statute of limitations can be tolled or extended for certain reasons. This means that the deadline to file a civil lawsuit for certain claims can be extended due to factors beyond one’s control. For example, if the injured party is a minor at the time of the injury, the statute of limitations does not begin to run until the minor reaches the age of majority (age 18 in Michigan). In addition, if the injured party is mentally incapacitated due to mental illness or physical disability, the statute of limitations will be tolled until the person is mentally capable of understanding the claim he or she is filing. It is important to note that statute of limitations and deadlines vary depending on the type and locality of the claim. Therefore, it is critical to consult an experienced attorney to ensure that you are filing your claim within the applicable statutory period.
