What is the Equal Pay Act?

The Equal Pay Act of 1963 is a law that is designed to ensure that men and women working in the same job or working in similar jobs are given equal pay for equal work. This act was passed in the United States on June 10, 1963 in order to end disparities between male and female wages. It applies to employers covered by the Fair Labor Standards Act and prohibits employers from discriminating against employees on the basis of gender by paying them differently for equal work. The Equal Pay Act applies to all employers in South Dakota and prohibits them from paying employees of one gender less than employees of another gender for substantially similar work. In addition, the Equal Pay Act also requires employers to pay the same wages to employees regardless of race. The Act requires employers to keep accurate records for comparing wages and to make sure they are not discriminating against employees because of sex. Employers who violate the Equal Pay Act may be charged with criminal or civil penalties, including fines and back pay to employees. Employers in South Dakota must follow the Equal Pay Act in order to comply with the law and ensure that their employees are not disadvantaged because of their gender. The Equal Pay Act is an important law that seeks to ensure that all employees, regardless of gender, race, or age, are treated fairly and paid equally for the same work. It is important for employers to understand this law and implement procedures to ensure they are in compliance.
