What is the Americans with Disabilities Act Amendment Act?
The Americans with Disabilities Act Amendment Act (ADAAA) is a civil rights law that was passed in 2008, making it easier for people with disabilities to protect their rights in the workplace. It expands the definition of disability to include “conditions that are often episodic or in remission” and provides new protections for people with disabilities in Texas and around the country. The ADAAA requires that employers make reasonable accommodations for employees with disabilities, such as providing auxiliary aids or restructured job duties, unless the employer can demonstrate that doing so would cause undue hardship. Additionally, the ADAAA significantly broadens the scope of the legal definition of disability, expanding it to include conditions such as cancer, diabetes, or depression. The law also prohibits employers from discriminating against applicants or employees based on their disabilities. Employers must make reasonable accommodations for otherwise qualified applicants or employees, and they cannot refuse to hire applicants with disabilities or make decisions based on stereotypes or assumptions about their disabilities. The ADAAA also requires employers to provide reasonable accommodations for test-takers with disabilities. The ADAAA is an important civil rights law that helps ensure that people with disabilities can enjoy the same rights, privileges, and opportunities as their non-disabled counterparts. It provides Texans with disabilities with additional protections against discrimination in the workplace, and ensures that employers cannot deny them their rights based on stereotypes or assumptions.
