What remedies are available for a civil rights violation?
Remedies for civil rights violations in Indiana are largely dependent upon the type of violation that has occurred. For example, individuals or entities that have been a victim of discrimination based on race, religion, sex, or disability, can file a complaint with the Indiana Civil Rights Commission. The Commission will investigate the case and may resolve the matter through either a settlement or a lawsuit. In either case, the Commission may provide remedies such as back pay, front pay, damages for emotional distress, or other forms of equitable relief. Individuals who have been subjected to unjustified searches or seizures may be able to bring an action for monetary damages against the entity or individuals responsible for the conduct. The damages may include compensation for lost wages, pain and suffering, and punitive damages. Victims of police brutality may be entitled to compensation for their injuries as well as punitive damages if the conduct was particularly egregious. In addition, the victim may be able to bring a claim for violations of their constitutional rights, such as unlawful arrest or excessive force. Finally, individuals who have been subject to unconstitutional conditions or treatment by a government agency may be able to file a claim for damages, injunctive relief, or other equitable relief. This type of claim requires a showing of a violation of a constitutional or statutory right and thus would need to be evaluated on a case by case basis.
