What civil rights do people with disabilities have in education?

In Virginia, people with disabilities have several civil rights regarding education. These rights are protected by both federal and state laws. According to the Individuals with Disabilities Education Act (IDEA), all students with disabilities are entitled to a free and appropriate public education from ages three to 21. This means that students with disabilities are entitled to all of the same educational services and resources that non-disabled students have access to. In addition, the Americans with Disabilities Act (ADA) also ensures that all students with disabilities are given equal access to school programs and activities. This means the school must make reasonable accommodations to ensure that the student’s disability does not prevent them from fully participating in the program. This can mean providing assistive technology, adjusting the physical environment, or providing alternate methods of assessment. The Virginia Special Education Regulations further protect the civil rights of students with disabilities. These regulations guarantee that each student with a disability has an individualized education program (IEP) that is tailored specifically to meet their educational needs. The IEP must be reviewed and updated annually and the student must be able to meaningfully participate in the development and implementation of the IEP. These laws ensure that all students with disabilities in Virginia have the same civil rights as other students when it comes to receiving an education.
