When can I file a claim under Dangerous Products Law?

In Florida, individuals can file a claim under the Dangerous Products Law when they have been injured due to a defective product. The claim must be filed within four years of the date of injury. If the injury was due to a product with a warranty, the claim must be filed within the time stated in the warranty. Individuals who were injured by a product not covered by a warranty, or who waited longer than four years to file a claim, may be able to pursue a claim by showing that the product was defective and unreasonably dangerous when used as intended or when warned against reasonably foreseeable uses. In addition, individuals may be able to pursue claims against those responsible for manufacturing, distributing, marketing, or licensing the product by showing that they were negligent in their actions. Individuals may also be able to pursue a claim against those who knew or should have known about the defects of the product, but failed to warn potential consumers. In Florida, individuals must file a claim as soon as possible after their injury. If a claim is not filed within the time limits, the injured individual may be prohibited from pursuing a legal remedy. It is important for individuals to contact an experienced lawyer as soon as possible in order to discuss their case and determine their legal options.
