What are the different types of product liability claims?
In Florida, product liability claims fall into three main categories: negligence, breach of warranty, and strict liability. Negligence claims are based on the idea that someone in the product’s chain of distribution (the manufacturer, seller, or distributor) was careless in the product’s design, manufacture, testing, inspection, or labeling. The claimant must prove that the defendant either caused the injury or was responsible in some way for it. A breach of warranty claim occurs when a manufacturer or seller does not meet the standards they promise in the product’s warranty. A breach of warranty claim can be made if the product fails to work as expected, or if it causes harm. Finally, strict liability claims involve an injury, illness, or damage that is caused by a product from a manufacturing or design defect. The claimant does not need to prove that the defendant was careless or negligent in their actions. Instead, they must simply show that the harm resulted from a defect in the product. In Florida, individuals injured by dangerous products can pursue legal action against the responsible parties. In order to do so, they must be able to prove that the product, its design, or its manufacture is to blame for their damages. The three types of product liability claims—negligence, breach of warranty, and strict liability—are the main ways in which individuals can do this.
