What are the different types of product liability claims?
Product liability claims refer to legal claims that consumers may bring against a manufacturer or seller of a product due to a defect in the product that causes injury or property damage. In North Carolina, there are three types of product liability claims: design defect, manufacturing defect, and failure to warn. A design defect occurs when the design of the product itself is wrong or faulty. This type of defect can make the entire line of products unusable and dangerous. An example of a design defect would be a car with a dangerous steering mechanism. A manufacturing defect is when a specific product does not meet the manufacturer’s intended design specifications. This could be something as simple as using a wrong type of nut on a motorcycle, which could make it unsafie. Lastly, a failure to warn is when a product contains a risk or hazard that is not clearly presented in the warning labels or accompanying instructions. An example of this would be a medicine that could cause an allergic reaction, but which does not have an allergy warning. In North Carolina, consumers have the right to seek compensation for injury or property damage caused by product defects. Whether the product has a design defect, a manufacturing defect, or a failure to warn, the consumer may be entitled to financial compensation for their loss.
