What are the statutes of limitations governing product liability claims?

In Oklahoma, product liability claims are subject to statutes of limitations, which vary depending on the type of case. Generally, personal injury claims must be brought within two years of the time the injury occurred. Property damage claims must be brought within two years from the date of the injury or within three years from the date the product was delivered. For product liability claims based on wrongful death or strict liability, the statute of limitations is two years from the date of death. For fraudulent concealment claims, the statute begins to run when the plaintiff learns of the injury or harm. In this situation, the statute of limitations cannot exceed four years from the date of death or injury. For all product liability claims, if the person harmed or killed was a minor at the time of the injury or death, the limitations period does not begin until the child’s 18th birthday. In that case, the plaintiff has until the child’s 20th birthday to file a claim. If the product liability claim is against a government entity, the plaintiff must provide the government notice of the claim within 180 days of the injury or death. When filing a product liability claim, it’s important to be mindful of the statutes of limitations so that you don’t miss the deadline, as this could mean the loss of your rights to pursue legal action.
