What is a design defect?
A design defect is a flaw in the design of a product that makes it unreasonably dangerous to use. Design defects can sometimes be difficult to detect, as they are often integrated into the product’s structure. In Arizona, design defects are governed by the state’s dangerous products law. Under Arizona’s dangerous product law, there must be a connection between the design defect and the injury that the product caused. This means that the product must have been designed in a way that was unreasonably dangerous, or that the product failed to perform in the way that a reasonably prudent person would expect it to. In cases of design defects, it is often difficult to prove that the product was indeed unreasonably dangerous. This is because the product may have been designed properly, but the user may have used the product in an unsafe manner. This is why Arizona requires evidence that the product was unreasonably dangerous even when used correctly. In Arizona, the court may determine that a product was defective when the manufacturer failed to use reasonable care in designing the product, or when the risk of harm from the product outweighs the product’s benefits. Therefore, for a design defect claim to succeed, it must be demonstrated that the risk of harm from the product was significant and foreseeable.
