What is a manufacturing defect?
A manufacturing defect is when a product has a flaw in its design, construction, or manufacture that makes it unsafe for its intended use or danger to its user or consumer. This means that the product did not work the way it was meant to or had a flaw that made it unsafe even though the manufacturer followed the instructions and standards when making the product. A manufacturing defect is different from a design defect, where the product is safe but does not work in the way it was intended. In Maryland, dangerous products law requires vendors and manufacturers to inform consumers of any potential dangers associated with their products. This includes informing consumers of any manufacturing defects that could lead to unsafe use of the product. It is the responsibility of the manufacturer to check for defects in products and ensure they are safe to use before releasing them for sale. Manufacturers are also required to provide repair or replacement services for products that have a manufacturing defect.
