Can I sue for emotional distress caused by a defective product?

In Maryland, if a defective product has caused emotional distress, you may have the right to file a lawsuit against the company or person responsible for the product. In order to file a lawsuit, you must prove that the product was defective and caused your emotional distress. It must also be shown that the product manufacturer either deliberately or negligently created a product that posed a risk of causing harm to consumers. In general, emotional distress that arises from the use of a product is typically classified as “negligent infliction of emotional distress”. Under Maryland law, you may be able to seek damages for emotional distress related to a defective product if you can prove that the product caused you severe emotional distress. You will need to establish that the harm was caused by the product manufacturer’s breach of duty and that the injury was foreseeable given the defect. Additionally, the defendant must have failed to use reasonable care in manufacturing or selling the product. In Maryland, in order to pursue a lawsuit based on negligent infliction of emotional distress, you must file the action within three years of when the injury occurred. If you can prove that the injury was caused by a dangerous product, and that the distress is severe, you may be able to recover damages for your emotional distress. However, it is important to speak with a qualified attorney to determine whether or not you have a valid claim.
