What is a defective product recall?
A defective product recall is a process used to remove a dangerous product from the market. In Maryland, when a product is found to be defective, it must be recalled to protect consumers from harm. In order to initiate a recall, a government agency, such as the Consumer Product Safety Commission (CPSC) or the Food and Drug Administration (FDA), must confirm the product is indeed defective and poses a risk to consumers. Once the agency confirms the risk, the responsible manufacturer, distributor, or seller must then issue a public recall and immediately stop selling the product. The recall must also include information to the consumers regarding the defect, potential risks, and instructions on how to return or dispose of the product safely. Manufacturers may also issue a repair, replacement, or refund in lieu of a full recall. This is not a mandatory action and only needs to be done if the product can be safely modified. In Maryland, defective product recalls are regulated by the Department of Labor, Licensing, and Regulation, which is responsible for ensuring recalls are properly conducted. They create safety and compliance policies to keep consumers safe and issue fines to companies who fail to comply with product recall guidelines.
