What is “strict liability”?
Strict liability is a legal concept used when talking about dangerous products law in Washington state. It means that a manufacturer, wholesaler, and/or seller of a product can be held liable for damages caused by the product, even if they utilized all possible care and did not know that the product was likely to be dangerous or defective. Essentially, this means that any party in the supply chain of the product can be held responsible for the injury caused by the product, as long as the product was dangerous or defective in some way. Strict liability is distinct from negligence, which means that harm was caused by a lack of care or intent. Under strict liability, it does not need to be proven that the manufacturer or seller was negligent; instead, they are held responsible for the damages regardless of their intent or lack thereof. This allows people who have been injured by defective products to be compensated much more quickly and easily. In Washington, strict liability applies to all products, whether or not they are considered to be “dangerous” or “defective”. This means that any party in the supply chain of any product can be held liable for damages caused by it, as long as the product was the cause of the injury.
