What is a statutory defense?

A statutory defense is when a defendant in a case can use a law in their defense. This means the defendant can show that they followed the law and so are innocent of any charges they may be facing. In Oklahoma, when it comes to dangerous products law, a statutory defense applies in cases where a product is proven to be dangerous or defective. This allows the defendant to show that they complied with the law by properly labelling and warning of any risks associated with the product. In such cases, the defendant may be able to show that the product’s risks were clearly communicated and that therefore, they are not liable for any damages resulting from using or consuming the product. This may be done in a variety of ways, such as proving that a warning label was present or that a product is known to be dangerous and therefore should be avoided. In Oklahoma, providing a successful statutory defense can result in reduced or even dismissed charges.
