What is a data subject access request?

A data subject access request is a legal right given to individuals in Florida, and other states, under data security law. It allows an individual to make a formal request for any personal data that an organization holds on them. Individuals can ask for this data to be shared in a readable format, to check its accuracy, or even delete it. All organizations that process personal data must comply with a data subject access request. In Florida, individuals can put their request in writing, and the organization should respond within one month. The individual does not have to provide any reasons for making the request. Depending on the complexity of the request, the organization might require further information from the individual and can extend the response deadline. Organizations cannot charge any fee for providing the requested data, unless the request is deemed to be excessive. The organization might also refuse the request if the data does not belong to the individual, or if the data is subject to an exemption under data security law.
