What is the difference between a first-time and a repeat DUI offense?

In North Dakota, the law distinguishes between a first-time and repeat DUI offense. A first-time offense of drunk driving is most commonly identified as a Class B misdemeanor, which carries a penalty of up to 30 days in jail or a $500 fine. The license of the driver may also be suspended for up to 91 days. A repeat DUI offense is a more serious crime. It is classed as a Class A misdemeanor with the potential for up to one year in jail and a $3,000 fine. The license of the driver is also suspended for up to one year. In addition to these penalties, the driver may also have to attend substance abuse classes and may even be required to install an ignition interlock device in their vehicle. The amount of jail time and the severity of the fines for a repeat DUI offense are greater than that of a first-time offense. This is because the driver has been shown to be a recidivist, meaning that they have demonstrated that they have a tendency to continue to drive under the influence and need to be more heavily punished. The ignition interlock device is also used to monitor the driver’s behavior while they are out on the roads and ensures that they are not consuming alcohol before getting behind the wheel.
