Yes, you can stop a debt collector from calling you on your cell phone. According to the Fair Debt Collection Practices Act, or FDCPA, debt collectors are not allowed to call you on your cell phone without your express permission. This means that you must give them written consent to call your cell phone. In California, debt collectors are also not allowed to call you at any certain time unless you give them permission in writing. The FDCPA states that debt collectors can only call you between 8 a.m. and 9 p.m. local time. In addition, debt collectors are not allowed to contact you at work, if they know or have reason to know that your employer prohibits such calls. If you have told a debt collector that they are not allowed to call you, they must stop calling you immediately. If a debt collector harasses you or violates any of these rules, you can take action against them. You can file a complaint with the Consumer Financial Protection Bureau and state attorney general’s office.
