When is a debt collector allowed to contact me in person?
In Michigan, debt collectors are allowed to contact you in person only in certain circumstances. Generally, there is no restriction on a debt collector visiting you at your home or workplace. However, debt collectors are prohibited from causing a public disturbance or entering a private residence without the debtor’s permission. The Fair Debt Collection Practices Act (FDCPA) limits when a debt collector can contact you in person. They must be respectful and considerate, and not harass or abuse you. Generally, a debt collector can only visit you between the hours of 8:00 AM and 9:00 PM, unless you agree otherwise. Also, a debt collector must have a legitimate purpose for visiting you in person, such as serving you with legal papers, or discussing the terms of repayment. A debt collector is prohibited from visiting you more than once for the same stated purpose. If a debt collector visits you in person, they must identify themselves and give you the name and address of the creditor. They must not threaten or harass you in any way. Also, they are not allowed to enter your home without your permission. It is important to know your rights if a debt collector contacts you in person. If you believe a debt collector has broken any of the above rules, you may contact the Federal Trade Commission or a lawyer to file a complaint.
