Can a debt collector threaten to garnish my wages?
The short answer is no. According to the Michigan Department of Insurance and Financial Services, debt collectors in the state are prohibited from using deceptive, misleading, or aggressive tactics when attempting to collect a debt from an individual. This includes threatening to garnish wages. A debt collector must adhere to the Fair Debt Collection Practices Act when attempting to collect a debt from a consumer. This includes disclosing certain information such as the amount of the debt, the identity of the creditor, and a statement that the consumer may dispute the debt. Additionally, debt collectors may not threaten legal action if they cannot, in fact, take such action, or impose interest or other charges not authorized by the agreement creating the debt or by law. Therefore, a debt collector in Michigan cannot threaten to garnish your wages as a means of collecting a debt.
