Can a debt collector contact me if I’ve offered to settle a debt?
Yes, a debt collector can contact you even if you have offered to settle a debt. In Florida, debt collectors are allowed to contact you in order to get the money you owe them. However, they have to follow certain regulations when doing so. They cannot contact you outside the hours of 8 am to 9 pm, and they cannot threaten or harass you. They also cannot make false statements or use profane language. If you have offered to settle a debt with a debt collector, the collector can still contact you in regards to the debt, but the contact cannot be for the purpose of collecting the full amount of the debt. Instead, the contact must be to discuss the settlement offer. They can also contact you to let you know they received the offer, or if the terms of the offer have been rejected. Under Florida law, debt collectors have an obligation to treat debtors fairly and with respect. This means they cannot try to collect debt by using unfair or excessive tactics. If you feel that a debt collector has violated your rights under the law, you can take action by filing a complaint with the Florida Attorney General.
