Can a debt collector call my references?
Yes, in Mississippi debt collectors are allowed to contact your references in order to attempt to collect a debt from you. This may include your friends, neighbors, employers, and family members. They are allowed to do so in order to obtain information such as your address, phone number, or your place of employment in order to be able to contact you. It is important to remember that debt collectors cannot harass or abuse your contacts. They may not use obscene or profane language, threaten or harass, make false statements, or use any deceptive or misleading practices while attempting to collect a debt. The Federal Fair Debt Collection Practices Act (FDCPA) also protects you from debt collectors calling your references excessively. They are not allowed to call them more than once a week and are only allowed to talk about your debt to your references. If you feel as though a debt collector has violated your rights or harassed you or your references, it may be helpful to contact the Mississippi Attorney General’s office or the Federal Trade Commission in order to report the incident. In addition, you may wish to seek legal advice about how to handle the situation.
