Can a debt collector contact me if I’ve offered to settle a debt?

Yes, a debt collector can still contact you even if you have offered to settle a debt. In Mississippi, debt collectors are allowed to contact you to discuss the offer that you have proposed to settle the debt. However, this does not mean that a debt collector can call or contact you continuously. The Fair Debt Collection Practices Act (FDCPA) outlines the standards for debt collection practices. According to the FDCPA, debt collectors must follow certain guidelines when attempting to collect a debt from someone. Debt collectors are not allowed to contact a debtor repeatedly or continuously with the intent to annoy or harass the debtor. In addition, debt collectors must adhere to the hours of operation outlined by the FDCPA which states that calls should not be attempted before 8:00 a.m. or after 9:00 p.m. If a debt collector has violated the FDCPA in regards to your case, it is important to take legal action. Note, you should also keep documentation of any phone calls or letters received from the debt collector. This documentation can be used in the event that you file a lawsuit against the debt collector.
