How do I know if I am protected by the ADA?
If you live in North Dakota and have a disability, you may be covered by the Americans with Disabilities Act (ADA). The ADA protects individuals with disabilities from discrimination, and provides for reasonable accommodations and modifications to help them access goods, services, and activities that are available to others. To determine if you are protected under the ADA, look at the language in the law which states that a disability is defined as a physical or mental impairment that substantially limits one or more major life activities. If you have a physical or mental impairment that is severe, and you experience difficulty with activities such as working, going to school, or participating in daily activities, then you are likely covered by the ADA. You should also be aware that the ADA does not cover some types of conditions, such as substance abuse. In addition, the ADA only applies to entities such as employers, schools, and other public and private organizations. It does not protect you from discrimination in private homes or residences. Finally, if you believe that you are being discriminated against due to your disability, you can contact the U.S. Equal Employment Opportunity Commission (EEOC) or your State’s Human Rights Commission to file a complaint. They can provide information on filing a discrimination claim and the resources available to assist you.
